Terms and Conditions

PAYMENT POLICY. At time of reservation: the Security Deposit within 7 days of the date of reservation; 50% of the rent, within 60 days of the date of reservation along with return of this Agreement; and the remaining balance 30 days prior to the commencement of the Term. The Property will be released from this Agreement if this Agreement signed by Tenant and all payments specified above are not received by Landlord as stated above. Payments and all charges are in U.S. dollars.

SECURITY DEPOSIT. Provided Tenant has fully performed the obligations under this Agreement, the Security Deposit shall be returned to Tenant within 14 days after expiration of the Term. Landlord shall have the right to apply all or any portion of the Security Deposit for any default of Tenant, including breakage, damage, missing items or extraordinary clean-up required or discovered by Landlord at any time during or after the end of the Term. Landlord’s right to recover additional sums from Tenant shall not be limited by the amount of the Security Deposit. Landlord shall not be required to pay interest to Tenant on the Security Deposit nor maintain the Security Deposit in a segregated account.

CANCELLATION & CHANGE POLICY. If you must change or cancel any portion of the villa stay or services you have already booked, you must notify us IN WRITING (by email, fax or letter). Finally, please send your payments in on time to avoid cancellation of your reservation. No-shows, late arrivals, a reduction in number of persons in your group within 45 days of or after your arrival, and early departures from your villa are non-refundable. No refunds will be granted unless there is a serious problem which cannot be remedied within 24 hours, and/or which causes the Guest extreme, undue discomfort or serious inconvenience. Guests who abandon their villa without permission from Serenity Vacation Villas agree they have no rights to compensation.

There will be no refunds for no shows, lower number of persons, early departures, mandatory evacuations or loss of services due to force majeure. There will be no refunds if all or any portion of the Term is during High Season. If the Term is during Low Season: if Tenant gives Landlord written notice of cancellation at least 60 days prior to the commencement of the Term, 100% of Tenant’s payments will be refunded, except for the 5% administrative and processing fee; if Tenant gives Landlord written notice of cancellation less than 60 days but at least 30 days prior to commencement of the Term, 50% of Tenant’s payments will be refunded, except for the 5% administrative and processing fee. However, if Landlord is able to re-let the Property for the entire Term during Low Season, 80% of Tenant’s payments will be refunded, except for the 5% administrative and processing fee.

WE HIGHLY RECOMMEND TRAVEL INSURANCE! For peace of mind, Serenity Vacation Villas highly recommends travel cancellation insurance. If you must change or cancel any portion of the reservation you have already booked, you must notify us IN WRITING (by email, fax or letter).

HURRICANE POLICY. In the event of a pending hurricane (i.e., a hurricane warning is issued by the National Weather Service for an area where a property is located) during any part of the Term, Tenant MUST vacate the Property when instructed to do so by Landlord or its agent Chad Cawley, chad@serenitygardenvillas.com; (305) 542-9198, or other agent hereafter designated by Landlord.

Any unused rent will be refunded, except that the 5% administrative and processing fee will not be refunded and any security deposit will be refunded pursuant to the provisions otherwise stated herein.

It is the sole responsibility of Tenant to secure other lodging or make travel arrangements for an early departure.

UTILITIES. Landlord agrees to pay all reasonable costs for landscape maintenance, electricity, cable TV, internet and water. Landlord shall not be responsible for the failure to furnish such utilities if such failure is beyond Landlord’s control.

OCCUPANCY. At the commencement of the Term, Landlord shall deliver Property to Tenant free of other occupants, and in a sanitary and clean condition.

The Property shall be used as a residence with no more than the maximum allowable persons designated by Serenity for each Property. Should Tenant permit occupancy of the Property by any number of persons exceeding this number, Tenant will be required to pay for these additional persons, or vacate the Property immediately, at Landlord’s sole discretion.

Landlord’s agent will be at the Property to deliver the Property to Tenant on the date of commencement of the Term at 3:00 p.m. If Tenant’s arrival at the Property will occur on a different date or time, a lock box will be available at the entrance door to the Property’s residence. Check-out time is 10 am.

Tenant shall be liable for keys delivered to Tenant and not returned by Tenant at the rate of $20.00 per key.

CARE, MAINTENANCE AND REPAIRS. Tenant shall maintain the Property in a clean and sanitary condition. Tenant shall be required to pay for all damages to the Property caused by the negligence or misconduct of Tenant or Tenant’s invitees.

Landlord makes every effort to keep the Property in working order. In case of a maintenance problem, staff may enter Property to perform any repairs as necessary. No refund or rate adjustment will be made for unforeseen mechanical failures such as electricity, water, pool filtration systems, air conditioning, telephone, CableTV, appliances, etc. It is the Tenant’s obligation to report any problems or damage immediately to Landlord.

ALTERATIONS TO PROPERTY. Tenant shall not make alterations, additions or improvements in or about the Property.

SURRENDER OF PROPERTY. At the end of the Term, Tenant shall surrender the Property, together with all keys, in as similar condition as Tenant received the Property at the commencement of the Term.

RISK OF LOSS OF PERSONAL PROPERTY. All personal property brought onto the Property by Tenant shall be at the sole risk of the Tenant. Landlord shall not be liable for theft or damages for such personal property.

NUISANCE. Tenant acknowledges that the Property is adjacent or nearby to other residences, and Tenant covenants that Tenant shall not undertake any acts or carry on any practices which may injure the Property or be a nuisance or menace to adjacent or nearby properties. Tenant shall not allow at any time mechanical or electronic sounds, the barks of dogs, and other loud noises to permeate the surroundings with noise levels which infringe on other resident(s) of the Property’s community. Tenant shall keep all trash and garbage closed in the provided containers and place such containers curbside for pick-up no more than 24 hours in advance of scheduled pick-up time(s).

RIGHT OF ENTRY. Landlord and its agents and contractors shall have the right to enter upon the Property: at all reasonable hours with 24 hours prior notice for the purposes of inspecting the same, without prior notice for making repairs deemed essential by Landlord or making sure Tenant is complying with Tenant’s obligations; and without prior notice in the case of an emergency. Whenever feasible, Landlord shall make such entry only at a time and in a manner so as not to unreasonably interfere with Tenant’s occupancy.

ADDITIONAL TERMS AND CONDITIONS.

A. All Properties are cleaned just before your arrival and after your departure to ensure maximum cleanliness. If the villa you select does not have maid service included as part of the rental price, or if you would like service more frequently, this can easily be arranged for an additional charge. This service is for hotel-type general cleaning and tidying only; any personal laundry, cooking, or babysitting must be arranged in advance, and prices set according to services required. B. With advance notice, we can pre-stock your villa with food and beverages of your choice just before your arrival! This service allows our guests to quickly settle in, unpack and enjoy their accommodations and amenities immediately upon arrival. For grocery provisioning and all other such needs, please contact our concierge at reservations@serenitygardenvillas.com

C. We can arrange almost any special services you wish. Your concierges Chad Cawley and Lisa Navarro are our in-house restaurant, activities and watersports experts; they’ll give you information about all island activities such as sailboat and power boat charters, SCUBA diving, jet skis, parasailing, windsurfing, massage and spa services, etc., that you might wish to try during your vacation. We can also recommend excellent chefs who are available for select or daily meals during your villa stay. Chefs are able to discuss menus, special dietary requirements and your grocery shopping list. Chefs will require an advance deposit for both grocery shopping and for their services; you may pay them directly. Remember to plan ahead and reserve chefs in advance for all holidays. D. U.S.Virgin Islands law requires all children under 5 years old to be in a child-restraint car seat. Car seats are available from your rental car agency.

E. No pets of any kind are allowed on the premises unless Landlord consents in writing. Should Landlord give such consent, Tenant must comply with all applicable laws of the Virgin Islands relating to pets, including, but not limited to, any necessary licensing.

F. Smoking is not permitted inside the Property’s residence.

G. Possession on or use of illegal drugs or hazardous materials, or alcohol consumption by minors, on the Property is strictly prohibited.

H. Tenant shall indemnify and hold harmless the Landlord for any claims for personal injury or property damage caused by Tenant, or Tenant’s guests or invitees.

I. Landlord cannot predict construction in the areas on the island of St. Croix and, therefore, Landlord will not be responsible for any inconvenience to Tenant resulting therefrom.

J. Landlord is strongly committed to preserving our planet and conserving energy. Tenant shall not leave on any lights or appliances when not in use; Tenant shall turn off the air conditioning when window(s) or door(s) are open or when the Property’s residence is not occupied; and Tenant shall restrict water usage as much as reasonably possible.

K. Landlord represents that the Property is fully furnished, with full kitchen, washer/dryer, sheets, bath towels and beach towels. Housekeeping and cleaning services are available at an additional cost to Tenant.

L. Landlord will not be responsible for any of Tenant’s lost items during or left at the Property after Tenant’s departure. Any such items found by Landlord after Tenant’s departure will be returned to Tenant by Landlord only upon Landlord’s receipt of a written request from Tenant within 14 days after Tenant’s departure. Any costs of shipment of such to Tenant shall be at the sole expense of Tenant.

M. Tenant shall not attempt to gain access to any locked closet(s), shed(s), storage area(s), garage(s), or any other locked or marked restricted structures or areas on the Property.

N. All motorized vehicles must be licensed by the Government of the Virgin Islands. All drivers must observe a reasonable and prudent speed limit. Tenant shall not park any vehicle(s) in any manner so as to block streets or rights-of-way or park on green spaces. Overnight parking on streets may be prohibited; Tenant shall receive information from Landlord or its agent regarding rules and regulations governing overnight parking, Parking may also otherwise, and any gate entry may, be limited or subject to reasonable restrictions, including the requirement of obtaining temporary permits. Landlords or its agent shall arrange for or assist you in securing any necessary permits and gate entry.

O. Tenant shall not permit diving or jumping into any pool or Jacuzzi on the Property. Tenant will ensure that all minors shall be supervised and accompanied by an adult while such minors use the pool or Jacuzzi. Tenant shall not permit any horseplay or other activity posing an unreasonable risk to occur in or about the pool or Jacuzzi.

P. Tenant shall report any visible damage to the Property upon arrival, or any subsequent damage to the Property, to Landlord within 24 hours of discovery by Tenant.

Q. Landlord reserves the right to charge Tenant’s account and/or the Security Deposit provided by Tenant for any charges under this Agreement for violation of any provisions of this Agreement. Tenant expressly waives the right to dispute any such charge(s) by Landlord.

R. No weddings, special events, or other professional/commercial sponsored photo/video shoots are permitted on the Property unless Landlord consents in writing, which consent shall not be unreasonably withheld, provided permission to conduct such event is requested in writing to Landlord, and granted by Landlord, in advance of commencement of the Term. Landlord reserves the right to increase the Security Deposit in consideration of its consent for the holding of such event(s). Tenant, at its sole cost and expense, shall secure all necessary permits therefor.

S. Tenant shall not permit the climbing of trees. Landlord shall not be liable to Tenant for the acts of others, including the acts of any company or persons engaged in conveying or transporting any passengers to or from the Property.

T. Government issued photo ID may be required for access to the Property’ community or certain facilities. Tenant is required to carry and produce such ID when requested or required.

U. Landlord shall not be liable to Tenant for the acts of others, including the acts of any company or persons engaged in conveying or transporting any passengers to or from the Property.

V. The Property may be governed by covenants, rules or regulations of any applicable homeowner’s association or similar community association. Any such covenants, rules or regulations will be available at the Property for your review.

17. BREACH OF AGREEMENT BY TENANT. Tenant’s violation of any provision in this Agreement during the Term will result in immediate eviction and forfeiture of all of Tenant’s payments, and/or the pursuit by Landlord of any other remedies provided in this Agreement or by law, at Landlord’s sole discretion. In any dispute arising out of this Agreement the laws of the Virgin Islands shall apply and Tenant shall be responsible for the payment of all of Landlord’s attorney’s fees and costs in connection with any such dispute.
